The following terms and conditions of business define the agreement between you, the customer ("the buyer"), and Barnstaple Heritage Centre ("the seller"), for all services provided by us.

The goods are exclusively subject to, and in accordance with, the following terms and conditions.

1. Definitions and Law
The parties to the Contract are the Seller of the Goods and the Buyer. The person, firm company, corporation or public authority responsible for the delivery of the Goods to the delivery address, including the Seller when the Seller delivers, shall, hereinafter be referred to as 'the Carrier'. The person, firm, company, corporation or public authority to which the Goods are delivered when it is not the Buyer is hereinafter known as 'the Recipient'. This contract shall be governed by and construed in accordance with the law of England.

2. Risk and Title of Goods
The risk in the Goods shall pass to the Buyer immediately on delivery to the Buyer or to the Recipient.

3. Receipt
The Buyer or Recipient on behalf of the Buyer, shall receive the Goods and shall check the same for quantity and condition in the presence of the Carrier. If there is a shortage or if the Goods are, in an unsatisfactory condition, the Buyer or Recipient must so endorse the Carrier's delivery document and must give separate written notice thereof to the Seller within three days of delivery. If this condition is not observed, no claim In respect of shortage or of unsatisfactory condition of the Goods will be entertained. This condition does not affect the statutory rights of the Buyer.

4. Price
The price payable for the goods you order is as set out on our web site at the time you place your order.

Occasionally an error may occur with our web site and goods may be incorrectly priced in which circumstances we will not be obliged to supply the goods at the incorrect price.

We must receive payment for the whole of the price of the goods you order, and any applicable charges for delivery, before your order can be processed.

5. Payment
Payment shall be by PayPal via this site, or by ordering via letter with a cheque or postal order for the correct amount, including any delivery charges, or via phone using a credit card. To Barnstaple Heritage Centre, Queen Anne’s Walk, The Strand, Barnstaple, Devon EX31 1EU. Cheques and postal orders must be made payable to Barnstaple Town Council.

6. Return of Goods
On cancellation for whatever reason, you must return the goods to us at your cost. Any Refund will exclude all delivery charges already paid.
Where the goods are being returned because they are faulty or incorrect, we will meet the cost of return but we ask that you allow us to nominate the carrier.

7. Rights Reserved
Any failure by the Seller to enforce any or all of these conditions shall not be construed as a waiver of any of the Seller's rights hereunder.

8. Separate Term Validity
Should any term in this Contract be held invalid such invalidation shall not affect the validity of the remaining terms. Headings in these conditions are for reference purposes and shall not affect the interpretation of these conditions.

9. Terms of Contract
These conditions have effect in substitution for and to the exclusion of, any Condition put forward by the Buyer.
